Regulations of the www.marachic.pl online store


§ 1. General information


    
"DUCHESS" with its registered office in Księżno (postal code: 14-405), hereinafter referred to as the "Seller", entered into the Central Register and Information on Economic Activity, REGON 383055560, NIP 7393727138, enables the purchase of goods by means of a network electronic (Internet), at the internet address of the www.marachic.pl store

    
These Regulations are addressed to all users of the www.marachic.pl store and defines the terms of the purchase - sale transaction which takes place in the form of an agreement concluded via the website between the ordering party - hereinafter referred to as the Buyer and the company "DUCHESS", hereinafter referred to as the Seller.

    
Commercial information placed on the website of the www.marachic.pl online store does not constitute an offer within the meaning of the Civil Code, but constitutes an invitation to submit offers to conclude a sales agreement in accordance with the terms of these Regulations.

    
The goods offered in the www.marachic.pl online store are new, handmade and described in detail, including in terms of their properties, price, materials from which they are made, etc.


§ 2. The rules of using the store


    
The condition for using the service is acceptance of these Regulations by the Buyer.

    
The  www.marachic.pl store allows you to buy goods offered by the store via an electronic network.

    
The subject of the contract is a product according to the specifications of the order placed. The rights and obligations of the parties resulting from the concluded contract are regulated in the Act of 23 April 1964 Civil Code and in the Act of March 2, 2000. on the protection of consumer rights and liability for damage caused by a dangerous product.

    
Orders are processed in the order in which orders are received, until the stocks covered by this form of sale are exhausted.

    
At the Buyer's request, an invoice is issued - provided that such information will be included in the order form (in the "Customer comment" field).

    
The user who has used the store is required to:

- non-delivery and non-forwarding of content prohibited by law;

- using the store in a way that does not interfere with its functioning;

- non-sending and not placing commercial information within the store;

- use the store in a way that is not harmful for other customers and for the store administrator;

- using the content posted on the store's website for personal use;

- use the store in a manner consistent with the regulations in force on the territory of the Republic of Poland, provisions of the Regulations, as well as general principles of using the Internet.

§ 3. Placing an order and concluding a sales contract


    
In order to place an order and conclude a sales contract, you must place an order using the website www.marachic.pl by selecting products from the available store offer by adding them to the basket and filling in the form all the necessary data necessary for shipment and selecting the selected form of delivery and payment . The sales contract is concluded in Polish between the user of the store (the Customer) and "DUCHESS" based in Księżno and takes place at the moment of receiving the confirmation of the contract to the e-mail address provided in the form.

    
The store accepts orders placed online 24 hours a day, on all days of the week. Orders placed on non-working days will be executed on the first working day following the day on which the order was placed.

    
The customer can place an order without having to permanently register his data in the store's database (so-called shopping without registration via the on-line store, telephone or email).

    
Until the approval of the product selection with the "Confirm", "Order" or "Continue" button, the user has the option of making changes and modifications to the products in the order as well as contact details for sending or invoice.

    
The customer has the right to cancel the order before receiving from the Store the confirmation of acceptance of the purchase offer, i.e. before receiving an email confirming the acceptance of the order for execution. In the present case, the customer should immediately contact the store by e-mail or telephone.

    
All customers who have purchased the product will be informed of any change in the status of their orders by email.

    
The store reserves the right to reject the order, if there is no possibility of contact with the buyer or contact details of the buyer are incorrect, incorrect or incomplete, the transaction was not authorized in the electronic payment system or payment for the order was not paid within a specified period (in In case of payment by bank transfer) or the parcel will not be picked up (in the case of COD shipments). Before refusing the realization, the Seller will try to contact the Customer in order to determine the missing data.


§ 4. Delivery and collection


    
The deadline for the order is visible on the order summary and it is up to 7 business days. In exceptional cases, the term may be extended, about which the Customer will be immediately informed on the e-mail address provided in the form.

    
The products are delivered to the address indicated on the territory of the Republic of Poland. Fees for the delivery of products are given in the ordering process.

    
Estimated delivery time by courier is 1 business day, counted from the day following the shipment.

    
The cost of shipping the goods to the customer is covered by the Buyer. In the situation of offers covered by the promotion "Free delivery", the costs of shipping the goods to the Customer are covered by the Seller.

    
When collecting the parcel, the customer should check the condition of the outer packaging of the parcel in the presence of the courier. In the event of its damage, the Customer should prepare a damage report together with the courier in two identical copies signed by the courier and the Customer.

§ 5. Prices and methods of payment


    
The given product prices in the online store www.marachic.pl are gross prices (in Polish zlotys).

    
The Customer may pay for the order any of the methods available in the Store:

- Quick payments - a very easy and simple way to pay for ordered products. The delivery time is immediate.

- Cash on delivery - one of the most common forms of payment by customers, the money you pay when picking up the package. This payment method can be processed by Poczta Polska and DHL courier.

- Pre-payment (bank transfer) - after placing an order, you will receive an automatic "order confirmation" and "waiting for payment via bank transfer" with your details and the number of our bank account to which you have to transfer the amount. When we receive the money on the account, we will carry out the order.

    
If the Customer chooses a payment method in the form of a prepayment, no payment to the "DUCHESS" account or intermediaries in the transaction (electronic payment service) within 7 days of placing the order will result in the order being canceled. In this case, you can place orders again and choose a different payment method.

    
The seller reserves the right to change the prices of products on offer, withdraw from the sale of certain products and introduce new products to the online store offer, carry out and cancel promotional campaigns on the store's websites or make changes to them.

    
Information on the prices of goods given on the Store's website is binding - within the meaning of the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product - from the moment the Customer receives an email confirming the order he has placed until the order is fully processed. This price remains constant irrespective of changes in prices in the Store, made after confirmation of the order.


§ 6. Complaints and returns


    
If the product purchased in the www.marachic.pl Store has defects which constitute its non-conformity with the concluded sales contract, it may be advertised subject to the terms and dates of complaints specified in these regulations.

    
The buyer may submit complaints via e-mail to the address of the company "DUCHESS" given above in the regulations or via the contact form.

    
The customer may submit a complaint by post, by returning the goods, along with a description of the defect and proof of purchase, to the address of the seller with the note: "Complaint". The customer will receive information about the result of the complaint within 14 days from the date of receipt by the Seller of the letter containing the advertised goods. In the event of a positive consideration of a complaint submitted by post, "DUCHESS" will send a repaired or new product to the Customer within 14 days, and if this proves impossible, it will return the full amount of the price paid.

    
If the complaint is not taken into account through the  www.marachic.pl Shop, the goods will be sent back at the customer's expense together with the opinion that the complaint will not be valid.

    
If the Customer finds damage to the goods during transport, the Customer is obliged to draw up a damage report in the presence of the courier. Complaints arising from damage to goods during transport will be considered on the basis of a damage report prepared by the customer and courier.

    
The customer has the right to withdraw from the contract of sale without giving a reason, within 10 days from the date of receipt of the goods and return the goods at the earliest possible date to the store. The condition for including the return is submitting a written statement of withdrawal from the contract, and then sending to the address of the store at the cost and risk of the customer purchased goods (unused and clean product, "odorless" such as creams, perfumes) and proof of purchase (receipt or invoice VAT ) together with the original label in the original packaging. The money will be sent back within a maximum of 14 business days to the account number provided by the Customer. The amount covering the price for the goods covered by the contract, which the customer has exercised with the right of withdrawal, is subject to refund.

    The exception to withdrawal from the contract are products that have been modified at the customer's request (i.e. change of bow tie stitching, change of wood type, engraving, extension of the order with a sheath or cufflinks). In other words, any changes that the customer applies to the order.

     The store has the right to refuse to accept the return of goods in cases of returning damaged goods or delivering to the store defective goods, ie incomplete or used.

    
The www.marachic.pl store does not accept any parcels sent on delivery.

§ 7. Processing and protection of personal data

Providing personal data, as well as consent to their processing are completely voluntary. All personal data provided to us are processed only to the extent and purpose for which the CUSTOMER agreed. In the event that the CLIENT does not provide the data necessary to perform the order and does not agree to their processing, it will be impossible to complete the order.

        
The administrator ensures the security of the transferred data and the implementation of CUSTOMER's rights resulting from the GDPR Regulation. All personal data provided during the ordering process is used only to form, conclude, change or terminate the Contract between the SERVICE PROVIDER and the CLIENT and fulfill the Contract of Sale or contract for the provision of electronic service or order fulfillment and are not made available to other institutions or third parties - except those described in point .8.

        
In the case of the sale of products through the www.marachic.pl store in order to deliver products to the CUSTOMER, personal data necessary to address and deliver the parcel are provided to companies professionally involved in delivering parcels - courier companies and Polish mail - along with entrusting the shipment to be delivered.

        
If the CUSTOMER agrees to the processing of his data for marketing purposes and sending commercial information and signs up on the list of subscribers, he will receive a "newsletter" to the e-mail address provided by him. The CLIENT may terminate the newsletter service at any time.

§ 8. Additional provisions

    
Customer's personal data provided during registration in the store are processed by "DUCHESS" only to fulfill orders and may also be processed for marketing purposes of the "DUCHESS" company.

    
The customer has the right to supplement, update, rectify personal data, temporary or permanent suspension of their processing or their removal if they are incomplete, out-of-date, untrue or have been collected in violation of the law or are no longer necessary to achieve the purpose for which they were collected, and the right to object to the processing of personal data for marketing purposes.

    
By placing an order, the customer agrees to use the store in accordance with the provisions of these Regulations - in the wording of the order and agrees to receive commercial information within the meaning of the "Act on the provision of electronic services", in accordance with these regulations. Lack of acceptance of the provisions of these Regulations prevents the purchase of Goods offered by the store.

    
The Polish law is applicable to the contract for the sale of goods in the www.marachic.pl Store.

    
The  www.marachic.pl store reserves the right to amend the Regulations at any time. Amendments to the Regulations are effective from the moment they are published on the store's website. Amendments to the Regulations may not violate the rights of acquired customers using the store.

    
The customer who has an account in the www.marachic.pl store will be informed about the change of the regulations via e-mail. If the client does not accept the changes introduced in the Regulations, he / she has the right to delete the account at any time.

If any of the provisions of these Regulations is deemed unlawful, void or otherwise unenforceable to the extent provided for by law, then it is excluded in this respect. In the remaining scope, the Regulations remain valid.

    
In the event of disputes related to the implementation of the contract, the parties will seek to resolve the dispute through out-of-court friendly proceedings - including to resolve the dispute before the mediator. If the dispute is not resolved in an amicable way, the court competent to resolve the dispute will be the Common Court at the registered office of the SELLER

    
In matters not covered by these Regulations, the applicable law will apply, in particular:
